We bought our house through shared ownership and have a mortgage for two thirds of the property. To cut a long story short our circumstances have changed and we will be moving out. If we sell it will be at a loss and we are not allowed to rent it out unless we own 100% share in it (which we can’t borrow). Feeling like we are stuck between a rock and a hard place I’m wondering out of curiosity what the worst is that could happen if we rented it out without the lenders permission? Many thanks
Others have said that the mortgage company could foreclose – they are correct but there is an extra problem….
If you have tenants in when the mortgage company re-possesses, then the mortgage company will evict the tenants. The tenants will then be able to make a civil claim against you for illegal eviction which could cost you thousands. I don’t think you’d be risking a criminal conviction but you might want to check that out too. (A criminal conviction can be 6 months prison).
